Overview
Dayforce provides features in the Dayforce HCM platform that use artificial intelligence or machine learning (“AI -Powered Features”), as well as features that provide analytics, insights, recommendations and similar functionality (“Insights”). Anything generated by AI-Powered Features or Insights is called “Output.”
AI-Powered Features and Insights are designed to support, not replace, human judgment. You should review Output before relying on it.
By accessing or using these features, you agree that this Policy governs your use of the AI-Powered Features and Insights.
Your Responsibilities
You are responsible for how you use AI-Powered Features and Insights. That includes making sure your use follows:
- applicable laws and regulations; and
- your organization’s internal policies and rules.
You are also responsible for the data, prompts, instructions, and other materials you submit, including making sure you have the right to use and submit them. Dayforce provides AI-Powered Features and Insights as tools. Their availability does not mean Dayforce guarantees they are lawful or appropriate for every use case. You should consult your HR, legal, compliance or other qualified professionals before using these tools in situations that could affect someone’s employment, rights, or benefits.
Demographic Data
Some Dayforce features may let you analyze workforce data by demographic categories, including categories protected by law.
If you use these features, you should make sure the analysis:
- is overseen by qualified HR, legal, or compliance professionals, as appropriate;
- follows applicable anti-discrimination, employment, and data protection laws; and
- is used only for lawful business purposes.
Employment Decisions
AI-Powered Features and Insights are not intended to be the only basis for decisions that have legal or similarly significant effects on a person.
This includes decisions about:
- hiring, promotion, demotion, or termination;
- pay, benefits, or bonuses;
- scheduling or shift assignments;
- performance or discipline;
- layoffs or restructuring; or
- training or career opportunities.
AI-Powered Features and Insights are designed to be used in connection with such decisions when:
- a qualified human decision-maker reviews the Output and makes the final decision using independent judgment;
- Your organization provides any disclosures or explanations required by law; and
- Your use follows all applicable laws (e.g., employment, privacy, anti-discrimination, automated decision-making laws, etc.).
Intellectual Property
You and your organization keep rights in the materials you submit, to the extent those rights exist. Dayforce and its licensors keep all rights in the AI-Powered Features and Insights and in the underlying technology, models and materials used to provide them.
Changes to Technology; Suspension
AI-Powered Features and Insights may include technology from third parties. You agree to follow any related terms Dayforce provides to you relating to these third parties. AI laws and technology change over time, and as a result, Dayforce may modify, suspend or remove AI-Powered Features, Insights or Output if needed for legal, security, compliance, operational, or third-party reasons, including if Dayforce reasonably believes this Policy has been violated, consistent with any applicable Dayforce agreement.
