Enhanced Employee Gender Administration Screen and the Compliance Framework

The Gender screen in HR Admin > Employee Gender Admin provides a new area for customers to administer custom-assigned sex and gender identity options. The Gender screen also includes new additional options for countries, US states, and Canadian provinces.

The compliance framework is a set of instructions and restrictions built into Dayforce that allows Dayforce, Inc. to provide gender-specific compliance updates if that country, state (in the United States), or province (in Canada) has a change in law. Customers are then limited to, or provided with, specific configuration options.

The Gender screen allows for customer enablement but it doesn’t mean that customers immediately have non-binary options in their system. If a customer doesn’t define options, the system acts as it does today and provides only male and female options throughout Dayforce (except for Germany, where two further options are provided by default).

The Gender screen is as a single location for customers to control their organization’s gender options in Dayforce. The Gender screen is found in HR Admin > Employee Gender Admin.

Note: Pronouns are administered outside of the Gender screen in HR Admin > Employee Gender Admin > Pronouns.

The following options are available to countries, US states, and Canadian provinces in HR Admin > Employee Gender Admin > Gender:

Collect Assigned Sex Information

  • This option enables or disables assigned sex for a particular state (in the US) and province (in Canada) when employees or administrators are providing this information.
  • This option is on by default.
  • This isn’t possible for some locations when ConnectedPay is in use.
  • This option can’t be disabled if assigned sex information exists for employees in this location.

Make Assigned Sex Mandatory

  • This option makes assigned sex non-mandatory for a particular state (in the US) and province (in Canada) when employees or administrators are providing this information.
  • This option is on by default.
  • This isn’t possible for some locations when ConnectedPay is in use.

Enable Gender Identity

  • This option disables gender identity for a particular state (in the US) and province (in Canada) when employees or administrators are providing this information.
  • This option is on by default, except for Germany.
  • This option can’t be disabled if gender identity information exists for employees in this location.

Also, after a row is expanded, it’s possible to configure the following options for a country, US state, or Canadian province:

  • Define additional custom-assigned sex options for employees, controlled by the compliance framework:
    • Where there is no regulation in a country, state, or province, customers are free to add options for their employees as required.
    • When regulation is a factor in a country, state, or province, customers must select from the Compliance Code field for the custom options to roll up to. This selection helps to ensure legal compliance for this location.
  • Define additional custom gender identity options for employees:
    • Except for Germany, there are no legalities around gender identity. As such, customers can use this field as their organization requires.

Notes on Compliance

It’s possible to make changes to the Gender screen that are not caught by the compliance framework. For example, although it’s possible to deactivate the collection of assigned sex data in the United Kingdom by clearing the Collect Assigned Sex Information checkbox, we advise that you don’t do this. This is because assigned sex information is sent during each payroll submission to HMRC (the UK Tax Office), and so Dayforce will fail validation for any UK employee without an assigned sex value.

Additional Notes

If a country, state, or province isn’t added to the Gender screen in HR Admin > Employee Gender Admin, it acts as it does today. This means that:

  • Assigned sex is visible and mandatory. Assigned sex options are limited to male and female, except for Germany where two additional options are available.
  • Gender identity is enabled, with the exception of Germany.

The United States and Canada can’t be added without state or province information, respectively. This means that:

  • Custom assigned sex and gender identity values can’t be provided at the federal level to the United States or Canada.
  • Only male and female options are available, because this is what Dayforce is legally allowed to report to applicable governments or downstream providers.
  • If regulations change in the future, Dayforce will be updated to allow for non-binary reporting at the federal level.

Language Updates

The term gender is becoming less used globally, and is being replaced with more modern and inclusive language and Dayforce is following this lead.

  • Gender is now the term used for the entire legal and non-legal sex in Dayforce for an employee.

This record encompasses where the employee lives or works, their legal sex (Assigned Sex), and non-legal sex information (Gender Identity).

  • Assigned Sex is the new term for gender, the legal sex of an employee. This value is used by Dayforce for any external legal or governmental purposes, such as equal opportunity reporting, Payroll, Benefits, and other areas.
  • Gender Identity, not to be confused with gender or assigned sex, is the non-legal sex of an employee. This value isn’t used for any external or governmental purpose, unless explicitly stated otherwise.
