Updated Dayforce to support requirements for the Employment Rights Bill passed in December 2025, which includes significant changes to Statutory Sick Pay (SSP). The bill requirements come into effect from 6 April 2026 and include the following changes:

  • The Lower Earnings Limit (LEL) has been removed and SSP is now available to all employees regardless of their weekly earnings.
  • The Waiting Days requirement has been removed and SSP is now payable from the first qualifying date of a sick absence, instead of from the fourth day.
  • The way SSP is calculated has been updated. Now, SSP should be paid at the lower amount of either 80% of an employee's average weekly earnings or the government-defined SSP weekly rate (£123.25).

Sick absences within 56 days continue to be treated as a single Period of Incapacity to Work (PIW). However, this might need some configuration updates.

To support this update, the following settings were added to the SSP Pay Rule in Pay Setup > Pay Policy:

  • Percentage of AWE to grant for SSP
  • Lookback weeks for AWE calculation
  • Consider this a new absence since April 2026
  • Average weekly earnings calculation method
  • Pay codes eligible for AWE calculation
  • Pay codes ineligible for AWE calculation
  • Pay categories eligible for AWE calculation
  • Pay categories ineligible for AWE calculation
  • Lookback days for linked PIW

Note: Some of these fields already exist in the SSP Eligibility Qualifier so make sure that the configuration in both fields is aligned. Also, in the qualifier, enter 0 in the Waiting days for SSP and LEL (Lower Earnings Limit) fields to configure it for the bill requirements.
