This rule can be used to comply with the San Francisco Formula Retail Employee Rights Ordinances. This legislation specifies how predictability pay should be calculated in each of the following situations:
- When an employer adds or subtracts hours from a scheduled shift with less than 24 hours’ notice, predictability pay is determined as follows: For each shift to which four or fewer hours were added or subtracted, the employer owes two hours of predictability pay. For each shift to which more than four hours were added or subtracted, the employer owes four hours of predictability pay.
- When an employer moves a scheduled shift with less than 24 hours’ notice to another time on the same day or to another day, but doesn’t change the shift’s overall length, predictability pay is determined as follows: For each shift that is moved four or fewer hours, the employer owes two hours of predictability pay. For each shift that is moved more than four hours, the employer owes four hours of predictability pay.
- When an employer both moves a scheduled shift to a different time and changes the shift’s duration, with less than 24 hours’ notice, predictability pay is determined as follows: If the sum total of the number of hours added or subtracted from the shift, plus the number of hours that the shift was moved is four or fewer, the employer owes two hours of predictability pay. If the sum total of the number of hours added or subtracted from the shift, plus the number of hours that the shift was moved is more than four, the employer owes four hours of predictability pay.
It’s recommended that you configure individual instances of the Schedule Change Premium Rule to comply with each situation described in the legislation.
The following six instances should be configured:
- For adding/subtracting minutes from shifts: One instance for 240 or fewer minutes (0-4 hours), and one instance for more than 240 minutes (4+ hours).
- For moving a shift: One instance for a move of 240 or fewer minutes (0-4 hours), and one instance for a move of more than 240 minutes (4+ hours).
- For adding/subtracting AND moving a shift: One instance for a combined total of 240 or fewer minutes (0-4 hours), and one instance for a total of more than 240 minutes (4+ hours).
